I have a problem. I bought a buy-and-hold investment property for $599,000 plus another $35000 closing costs in August 2006. I put $5000 down on the house and the rest is mortgage. But these numbers aren't really the issue here.

This house is in an area where there are lots of 2 family homes. Some of these homes have finished basements that are illegally rented out by the owner. I took my chances when I bought this house- I had intentions from the beginning of illegally putting 3 families in it.

I was getting 1800, 1600, and 1000 a month in rent from this house- the beautiful basement was getting the 1000 rent. 4400 a month total, pretty good. The 19 year old son on the first floor started getting in trouble with a retired ex-cop across the street. The cops were called to the house a couple of times. A couple of days later, the housing inspectors came by. No one let them in, but it's now a matter of time before they inspect my house. There is no legal below ground living in this town.

My temporary solution was to tell the basement apartment people they had to leave, and I told the people on the first floor to avoid the inspectors as long as possible.

The problem is... now I'm only getting 3400 a month in rent! This means that I am losing money every month, unless the value of this house increases faster than expected. I've pretty much decided I have to sell the house. Nevermind any interest I've paid on the mortgage, or the high taxes- I accept that loss. I'm worried about trying to sell a house that has tenants that are under lease for another year and a half, and I'm not even sure I can get a buyer for $650,000. Should I try to sell it myself to avoid the real estate commissions?

I accept I'm going to lose money on this house. I just want to minimize those losses and move on. If I were to pay 4-6% commission and dump the house for $600,000 it would be a disaster (that I can't afford)! Any advice at all is appreciated.

 SHORT-SALE THAT PUPPY! Even though you may be current on the loan, it can still be done! The mortgage company will allow you to discount that loan, which will allow you to make it positive cash flow again!

Things have been going great since I wrote this blog entry. The housing inspectors never came by, and the person who originally told me about the inspectors might have been bluffing for whatever reason. I've refinanced the house to an interest only loan, and I'm now expecting to make money on the house.

 Dude I'm new here as of today 7/6/07 . I do alot of rehab work on homes and have to pull permits and deal with the towns all the time including  NY. I'm from NJ and these 2 states if 1 state does something the other follows. So to get at what I am saying if you play with fire you will get burned do not and I mean do not mess with town officials they will burn you. I have a saying about people with authority in the towns no offense if someone on here works for one. I see them when they were kids they got picked on all the time, so know all grown up they have authority and they will bust your balls so hard you will not be able to invest another sent in that town trust me when I tell you this. So if you play with FIRE YOU WILL GET BURNED            Good luck Buddy

I'm from Long Island NY just like it says in my profile, and this is what it looks like around here. The average house is worth $500,000 where I live. I have no idea what is so incredible to everybody. I did come up with a solution and I wrote it in my next blog.

Storytelling? Why would I take the time to write that in the first place, nevermind being so specific? And yes, my life is straight out of an HBO miniseries, Colin. I'm out on bail right now, and I'll be back in court on the 24th. They even impounded my $130,000 Mercedes.

Ok.....Wow,

First of all, the responses left by Ryan, Sean, and Maria are great.

I hope this isn't insulting but I read your blog with half a suspicion that you were writing fictional literature.

You were renting out to 3 families with your 600k house? Inspectors came? This seems like an episode from some HBO mini-series.......

You know what I think??? I think you may be one of the funniest guys I've met. For everyone who hasn't done so, please read Robert's profile. I couldn't help but laugh... great stuff Robert, great stuff.

I want to see pictures or video before I believe this story. Sorry it's too much. Send me the proof and I will write a full apology on this blog......... Let's see it bro. I'm waiting to be proven wrong.

Regardless, it's either a really tough situation where you got some great advice from or it was a great story and I may have you write one every week. What do you think??

Those values are ridiculous. where are you from? LA? I just picked up a 3 fam for 185k that pulls in 2800.00 a month. . the solution,,,move..hahaha

Is it possible to Open up access to the basement from one of the units and Increase the rent for that unit?

The best thing to do is to come clean.  I know this is not what you want to hear but....

In order to succeed in this business you really need to get along and know the City Offiacials, Inspectors,Heal Department etc. Call and speak to the Building Department and ask  what are the steps to (make ur property legal) pull permits etc.  In the long run by dodging the Inspectors is just going to add frustrations to the Inspectors and City Officials. Confront the situation. The town can easily talk to the Post Office and see who lives there...You will also get fines ( every state is different) per day, per month, per unit etc. 

Good luck...And like I said the Town Hall should always be your Best Friend.....
