This biggest mistake is growing by the day! 

Today I called the sister (past owner) and they have changed their story for me.  Her husband got on the phone and told me he NEVER walked the land with my realitor and he TOLD HER he didn't even know where the lines were drawn.  I KNOW my realitor.  She is such an ANAL person, she would not have let me go through this without a survey if they didn't convince her of the lines drawn.  The deed and recordings all show the same lines we thought we had.

I called the brother today (the owner of the other property who's renter ran off my survey men) and he said.. "Oh, I sold the property to them".  Now you can deal with them.  How did he do it?  How did he sell a piece of property in the middle of question in survey?  He recorded HIS map given to him and had the deed drawn up.  He owner financed the property to them.  He still tells me, 'THEY aren't going to take your front yard.  They are just "TALKING".  Then he told me they OFFICIALLY close Friday when they sign the papers.

Can I stop it?  Can I put a hold on it while the property is in question?  Is there anything I can do.  The new owners have told the brother if they don't get their "new found land" they are LEAVING to a new house.  They want to put a trailer in my front yard. 

I know.. I totally screwed up not getting a survey in the beginning.  Had ANYONE asked me, informed me that it would be a good idea on this particular tract, that it was in question... anything.. but NO ONE did.. I was new and didn't know.  Don't make my mistake.. if it's an estate, if the surveys are OLD... get a survey!!!!!!!!!!!

I'll keep you posted.. what the laywer says tomorrow.

today, the lawyer spoke with my realitor and both agree.  I don't OWE them anything and either I can go out there Saturday and we all can work something out that we ALL are happy about, or they can see me in court.  My lawyer says I have the law behind me, I have the TIME behind me (she died in 1969 and it's been the way it's been since then- UNTIL now).  They also have done wrong by sneaking around and selling the property to the new renters, KNOWING the survey was in question... she believes a judge would make all of this work out back the way it was and all would be well.  We will see how it goes on Saturday.  Wish me courage at 12pm est time!  I'm the type of person who hates confrontation, but 'let it be'.. I'm ready.
