For those following my survey problem that ran the NEW lines through my kitchen of the house and cut off the front porch of the back deck.... here's the update.
I had a survey done to check the lines that the neighbor had done. My lawyer insisted that I use the same guy who did the neighbor's property, because of his research etc... I didn't like that idea because I figured he isn't going to admit if HE did make a mistake, but he turned out to be very professional and worked hard to hopefully correct a mistake. There was NO mistake.
I called the original owner (daughter of the mother who died) and told her the whole situation about her brother (son of the mother who died), and how his land cuts across the house of HER old property. First thing out of her mouth... HE WROTE THE WILL FOR HIS MOM. She had no idea and was told all her life where the property lines should be. She didn't get a survey.. I was unaware of the whole situation and I didn't get a survey because the lines were "clear" to me.. a driveway and old logging road divided our land. Yea, right!
So, my survey done and clearly it cuts through my property and house. I talked with the brother/neighbor and he said he'd be willing to give me UP to my driveway (but NOT my driveway) .. only give me acess to it, down the logging road to the rail road tracks. In return, I had to give him the same amount of property coming BACK from the railroad tracks. What ever amount of land he is cutting off the front to GIVE me back, he wants in the back. My lawyer says, go for it. I think it smells like a rat.. I GIVE him land so he can GIVE ME back my own land... .of course, it legally never was MY land.. but I still don't like it.
My rent to owners aren't too happy about the situation, but... what can I do? They wanted that back square that he is taking back to put a pond back there. Since there is NO pond, I can't do anything about it right now... nor will I, because there is NO pond. Once they buy the property, they can put a pond back there and if they are clever, they will talk the neighbor into letting him add the pond on the little piece that they took back and share it. Then, it's not he never lost a piece at all. At least, I have the house back and the right of way to the driveway.. (which is silly to me until I found out he wants to add trailers down his property and use the driveway for their drive. That's really BAD because the driveway GOES into our carport... but "V" off down the logging road. Oh, well... best way I can fix the situation under the terms given to me. Lesson learned... if you are buying a "LOT" of land from an estate... ALWAYS ALWAYS get it surveyed!!!!!! Biggest mistake... SO FAR!
Anyway, it's going to be done that way and that's the end of the story, .... UNTIL I get the lawyer bill and survey fee!!!!!!!!!
