Here's the scoop.
Renters moved in June 07. The middle of May they gave me $1,500.00 deposit down (cash).
June 1st was first rent. I drove to their house on June 6th because I hadn't gotten anything in the mail and they gave me $1,225.00 cash plus the $25.00 late fee.
Middle of June they call me at 1130pm SATURDAY night to tell me the air quit working. I informed them that I can't do anything to it until heat/air people open on Monday. I did and they came out and put freon in the system... $350.00 worth ...
July 1st rent is due. I drive (each time an hour one way) to their house on July 6th because nothing in mail. She hands me a check for $1275.00. It's Saturday and one of my banks in their town is open on Saturday. I deposit it. By next Friday (after I had paid all my bills), the check gets pulled and bounces.
July 11th, I hand deliver a 10 day notice to pay up or get out. I also meet a real estate agent on site to introduce to my renters. If renters play nice, I sell the house and the investor will keep them. We all agree... nice plan. They agree that they will have all rent caught up by July 26th.
July 26th, no money. I call a lawyer who mails them a letter. I offer one more time to pay up or get out.
My letter states if they move by August 11th and leave the place clean and undamaged, I would tear up the felony bounced check I had in my hand and the contract of 24 months that they are liable for.
Nothing happens. No one answers my numerous calls.
August first.. no money. I call another lawyer and she calls them directly. They want to stay and complain that they don't owe me rent because there is a crack in the ceiling pop corn and the hall way wasn't painted good enough??? ??
She calls me with a plan and BEGS me to accept it. The lawyer says if I want to evict, I will not see any money. If I accept her plan, at least I MIGHT get some money from them.
Her plan. Pay me every Friday till she is caught up. I tell her if she misses ONE Friday, I am DONE! She leaves me with "trust me" !
August 4th.. she deposits (yes, I made her account to put her money in since she didn't have TIME to go to the post office during M-F). She deposits $300.00 into the savings account.
TONIGHT: At 530pm she calls to tell me it's 90o in the house and the air doesn't work. I tell her I will call someone tomorrow morning. At 830pm she calls me to tell me she is rushing her boy to the hospital because it's 90o in the house and his asthma attack is my problem and she will be documentating that I didn't FIX the air fast enough. (what the HECK that means??? I figure she thinks she is going to make sure I pay her hospital bill, I don't know).
Tonight at 930pm. I call and leave a message and it wasn't pretty or nice. I am sick and TIRED of this B.S! I've HAD it.. I called the air people at 930pm and left a message to hopefully get on their list tomorrow, but other than that.. what else can I do?!?
What would you do? I know what you'd LIKE to do, but I need serious answers. Answers that don't get me put in jail! LOL. I need to know what legally I SHOULD do next.


Never, EVER offer to tear up a bounced check, not until the full amount is paid. along with your NSF fees.We had renters who were doing laundry in the bathtub, yes, the bathtub, oily, nasty work clothes, and I had offered the use of my washer. The plumbig became all backed up. then they refused to pay rent because of the plumbing. We had to snake all the drains several times, then when they were clear again, you guessed it, they went right back to laundry in the tub, didn't pay, then moved while we were at work. Alwys check references and if someone says don't rent to them, toss their application in the circular file. If I had to go twice to collect, a notice to quit would have been in my hand, We had other tenants, lived right above us, who would blast music at all hours. then not answer the door if we went up to complain, they actually shut off the music until we went back downstairs, then up it went. They would never answer the door, and we had to wait until they had a piece of furniture delivered, and I followed the delivery man with a notice to quit. This tenant of yours sounds like she really knows how to play the system, but it will catch up to her, just straight up evict her, and you can sue for the money she owes, failure to pay a court ordered amount, if you win, will land her in jail if you push it.

I had the same problem with renters years ago. I'm not into renters and if I get back into it again I will hier a property management company. They get the people and the rent and if the people don't pay they pay the rent so you can pay your bills they don't want to loose business they are the one's that got the tenants. It is there reasponabilty to collect the rent.
The problem you have what I would do. First don't call them and leave bad messages that can be used in court believe me it happen to me but I had enough evidense on them I won. Let your lawyer handle everything from now on with these people. Things break down no reason not to pay rent. Things settle in a home and things crack. So the popcorn ceiling oh well shit happens. You live there if it bothers you so much get some paint and fix it I would tell them. I provide a place to stay it has running water, Lights, tiolet, Kitchen, Bathroom, Heat, and you are nice AC to. Things break down I will repair as fast as I can If you don't like it get someone else and send me there bill and I will pay, if not keep the rent coming to me you have no right to keep it. Either we work together or you can find another place to live. I don't like threats if you are going to threaten me good buy and do it to some one that cares. I rent to people and give them a place to live you don't pay me guess what you will have to leave.
If it was me 3 times not paying I let it go 2 times then buy by no games played here. Get better renters have them go by by tell your lawyer. The threats are no good for anybody and hurts people bad, so get rid of them and are they the same people with the bad tree on there lot that had a guy try and get money from you. While they are long over due by by. People like them think landlords have a lot of money and they will try to take as much as they can. Get letters from the neighbors to give to your lawyer the ones you can trust.
More advise when the courts throw them out the date they are suppose to be out bring some one with you witness and make sure they don't damage the home and make sure the neighbors watch the home to. When they see them moving out they are to call you and you go over with someone with you, people can be nasty be careful. Sorry this has happen to you but keep the faith it will work out good luck.
PS don't keep them let them go make sure you tell your lawyer he or she seems to easy well that is bull tell them to leave. GOOD LUCK

In my opinion thats how horrible advice to accept there payment arrangements outside of a court of law. You (and your lawyer) are really setting yourself up by not following the terms of the contract.
What if you don't make arrangements with the next late paying tenant and go straight to eviction? What if that tenant gets the ACLU involved who then subpoenas your records only to discover you treat different people differently? What if one person is of color and the other isn't? What if it becomes a racial thing and your fined heavily for violating fair housing laws?
That scenario described above is real and happened to someone I know. It cost him $17k in court and atty. fees & $20k in fines. And approx 15 months in lost rent while the court battle waged on. Can you afford that?
In Ohio - we legally can make arrangements with a tenant. But only in front of a judge. We start the eviction and then go in front of the judge and announce we have come to an agreement. This is called an agreed entry. We write the terms of the agreement down on paper, sign it and were done. If the tenant follows the term of the agreement everything is fine and the case is dismissed. If not - its an automatic eviction.
Things may be a little different down there in NC - but i doubt they are. I would immediately call another lawyer and start the eviction. Even if this tenant is able to pay - cut your losses and start over. They smell like trouble to me.

P.S. your tenants idle threats are worthless. In court they would get laughed at. AC is not a birthright its a privilege - if her sons health was that bad, she is being negligent by not taking somewhere that is cooler.
oh, the kicker is.. I had a history check done on them and was advised NOT to let them rent. I spoke with the renter about her lien and court date and she begged, promised me etc... this is all my doings... letting her get to my heart instead of business... I will 100% listen to the advice NEXT time.. This won't happen again.. yes, my other 10 renter's (most who rent to own) are amazing people. This is my only nightmare tenents.
The neighbors have called the sheriff out there so many times and the neighbors are calling me almost weekly now... their dog pooped in my yard, their kid walked across my yard, the dog is barking ALL the time.. they've taken one dog away from them, already. One of the kids threatned to harm a neighbor's car because he asked them not to sit on it. Maybe I can take all those police reports with me to eviction court, as well.
I think you are going to have to check with your lawyer about what the eviction process is in your state. Did they tamper with the air just to come up with an excuse not to pay? You are probably going to have to call in the Sheriff or deputies to get this person out.
It doesn't sound like you have had this problem before. You might need to do more renter qualifying before they move in. Do they have an apartment owners association in your town? They usually have access to the credit and job checking data for potential renters. I know this won't solve the problem for this one, but hopefully it will prevent future problems. Also, not that I currently have a property, but the only way I would do buy & hold is with lease-purchase agreements. You reduce the chances of this happening.
After you get them out, I would work to collect on that bad check. You can call the bank every day to verify if funds are available. If, on any day, the funds are available, RUN (don't walk) to that bank branch and have them trade the bad check for a bank cashier's check, which you can deposit. If it is NOT good within 3-4 weeks, sue them in small claims court. It sounds like your state also has a "felony" bad check law for checks of that amount. I would certainly use that as a hammer.
