I've been off off "air" for a little while, trying to regroup.  Things have been coming down all at once.  Any ideas for me out there?

1.  My crew has missed 1 week and 4 days work, so we are very behind.  But today was their first day back.  Hopefully we've come to some better understandings of what our focus needs to be. 

2.  My 6 month rent to owners, decided to bail out on me because their option fee was coming due (I gave them SIX months to come up with the other 1/2 of it) and their rent was going up $50.00. - because I gave them a discount to get in, they were in major hardship -  They decided to leave me with carpets I'd have to replace (I've already seen how dirty they were).  I'm not in a position to have another empty house right now, so I offered them rent only (no more option fee to have to come up with) and keeping their rent at $650.00 a month.  If ever they decide they'd like to buy/option, we'll cross that bridge when we get there.  They want to sign a 2 year contract now.

3.  My brand NEW people in the biggest house I own, didn't pay July's rent.  They wrote me a check on the 6th, when I showed up at the door, only to have it bounce on me and screw up my account.  Now, it is the 26th, the last day of their official 10 day notice and no money yet.  (nor will they even return my calls).  Tomorrow, I will go to their city and file a small claim against them. 

I also think there is more that I can do, can't I?  The check was for more than $1,000.00 so that is a felony, correct? 

I need some more advice on evictions.  Can someone write a blog or direct me to their blogs about how to evict someone quickly?  I've done the 10 day notice.  This is day #10... now what? I don't want to waste a day.  Next months rent is due in less than a week!!!! 

I want to write them a letter offering them a chance to volunteerily leave or I will ask for the entire contract to come due and if they clean and not damage anything on their way out, I would tear up the check and not go after a warrent for that.  I was told today that I can ask the court to honor the entire contract of 24 months and that would be what they would owe me.  Can I do that?

I have to echo Sean's sentiments, take the time to have an attorney do the whole process, you shouldn't waste your time dealing with this low energy be


My advice is to never take checks from any tenants. Never. I have them pay money order or bank check every time and they just do it, it's all about training.

If they tried handing me a check on the 6th, it would have been after they got their 3 day notice on the door and they were paying a hefty little late fee.

If rent is late, under NO exception should you ever take anything but certified funds.

Thanks.. I have an attorney sending out a letter for me tomorrow and is going to walk me through the eviction notice.. (she is a wonderful friend who happens to live in the same town of my rental house!)..

Hi Crystal,

 

Sorry to hear about your hardships. That stinks big time. You really need to consult an attorney to get the answers your looking for. I would be glad to give you advice, but i know its not worth anything. I'm in Ohio and your in N.C. Every state has there own set of laws.

In Ohio you can file for an eviction after a 3 day notice has been given. Part of the eviction is the damages or lost revenue from the lease not performing. The evicted tenant would be responsible for damages to the property, lost rent - up until you get the property rented again. 

If you cannot afford an attorney call the down to the county. Be nice and they will walk you through the process. For the record my attorney costs me about $400 per eviction - he pays the court costs and goes to court for me. It is well worth it for me - just for the time I save alone.
